This mobile application and website (together referred to as the "Platform") are owned and operated by Vinseva, a Unit of VCO Group of Companies (“NGO”, "Organization", "we", "our", "us"). By accessing, browsing, or using our Platform in any manner, the user ("User", "you") agrees to comply with and be legally bound by our Terms & Conditions, along with our Privacy Policy and other applicable policies. If you do not agree, you must discontinue use of the Platform immediately.
These Terms apply to all visitors, registered users, donors, beneficiaries, partners, and any other persons accessing our Platform.
1. Use of our Platform by
User
Our Platform may be used only for lawful purposes and in accordance with these Terms. Users shall not engage in any activity that is illegal, misleading, abusive, fraudulent, or harmful, or that violates any applicable law, regulation, or third-party rights.
2. Organization Website
& Platform Services
Vinseva operates as a
digital platform that enables registered organizations to establish and manage
their own dedicated organization website within the Vinseva platform. Upon
successful registration and approval, the organization is provided access to a
dedicated website, technically implemented as a sub-domain under Vinseva’s
primary domain.
The organization website
allows registered organizations to publish information related to their
mission, activities, programs, events, and other permitted content. Subject to
eligibility and compliance requirements, the platform may also enable
additional features such as donation collection, communication tools, and
content management functionality.
Vinseva provides only the technological infrastructure and platform support. The registered organization retains full responsibility for the accuracy, legality, compliance, and use of all content, information, activities, and transactions carried out through its organization website.
3. User Representations,
Covenants and Warranties

By using our Platform, the User represents
and warrants that:

The User has the legal capacity to enter
into these Terms;
·
All information provided by the User is
true, accurate, and complete;
·
The User will comply with all applicable
Indian laws and regulations;
·
The User is authorized to use any payment
method linked to our Platform;
· The User is not restricted or prohibited from using our Platform under any law.
4. Disclaimers
Our Platform and all
content, information, and services provided through it are offered on an “AS
IS” and “AS AVAILABLE” basis. Our Organization makes no warranties, express or
implied, regarding accuracy, reliability, availability, or suitability of our
Platform. We do not guarantee uninterrupted access, error-free operation, or
absence of viruses or other harmful components.
Any trust placed on information available on the Platform is strictly at the User's own risk.
5. Limitation of
Liability
To the maximum extent
permitted under applicable law, our Organization shall not be liable for any
direct or indirect losses, incidental, consequential, special, or punitive
damages arising out of or related to:

Unauthorized access to User data;

Errors, interruptions, delays, or
technical failures;
· Actions or content of third parties.
6. Indemnification
The User agrees to
indemnify, defend, and hold harmless to our Organization, its trustees,
directors, employees, affiliates, partners, associates and agents from any
claims, losses, liabilities, damages, penalties, or expenses arising from:

· Violation of any law or third-party rights.
7. Intellectual Property
Rights
All content in our Platform, including text, graphics, logos, trademarks, software, and design elements, is the exclusive property of our Organization or its licensors. No content may be copied, reproduced, modified, distributed, or used for commercial purposes without the prior written consent from our Organization.
8. Transactions and
Donations

Any payments or donations made through our
Platform are voluntary.

Donations are generally non-refundable,
except in cases of duplicate or erroneous transactions, subject to our Organization’s
Refund Policy.

Our Organization does not provide goods or
services in exchange for donations unless explicitly stated.

Funds received shall be utilized in
accordance with our Organization’s objectives and internal policies.
· Donations made through our Platform may or may not qualify for tax benefits under applicable laws. Users are advised to consult their tax advisors. Tax benefits, if any, are subject to statutory compliance and issuance of valid certificates.
9. Suspension and
Termination
Our Organization reserves the right to suspend or terminate User access, temporarily or permanently, if the User violates our Terms or engages in conduct that may harm our Platform or other users.
10. Third-Party Links
Our Platform may contain links to external websites. Our Organization does not endorse or control such third-party websites and is not responsible for their content or practices.
11. Changes to Terms
& Conditions
Our Organization may revise these Terms at any time. Updated versions will be posted in our Platform. Continued use after changes constitutes acceptance of our revised Terms.
12. Jurisdiction and
Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Courts located in [Bengaluru, Karnataka] shall have exclusive jurisdiction over all disputes.
13. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions shall remain valid. These Terms constitute the entire agreement between the User and our Organization concerning use of our Platform.

Users are responsible for maintaining confidentiality of login credentials and for all activities conducted through their account. Our Organization shall not be liable for any loss arising from unauthorized use of a User’s account.

By using our Platform, Users consent to the collection, processing, storage, and use of their information in accordance with our Privacy Policy. Our Organization may use anonymized and aggregated data for research, analytics, reporting, and improvement of services.

Notifications

Users consent to receive communications and records electronically and agree that electronic records shall be legally valid and admissible.

19. Force Majeure
Our Organization shall not be liable for failure or delay in performance due to events beyond reasonable control, including natural disasters, government actions, system failures, pandemics, or network outages.
20. Assignment
Users may not assign or transfer their rights or obligations under these Terms without prior written consent. Our Organization may freely assign its rights and obligations.
21. Waiver
Failure by our Organization to enforce any provision shall not constitute a waiver of such provision or any other provision.
22. Survival of Clauses
Provisions relating to intellectual property, limitation of liability, indemnification, governing law, and dispute resolution shall survive termination of these Terms.
